From 1 January 2021, the classification, labelling and packaging of chemicals placed on the market in Great Britain (England, Scotland and Wales) has been governed by the “Retained CLP Regulation (EU) No. 1272/2008 as amended for Great Britain”, commonly referred to as GB CLP.
The GB CLP Regulation sets out the requirements for classification and labelling chemical substances and mixtures in Great Britain. Following Brexit, GB CLP operates separately from EU CLP, and businesses must therefore ensure compliance with the rules of the Health and Safety Executive (HSE).
If your business is based in Great Britain and supplies from companies established outside of GB, for example in the EU or the European Economic Area (EEA), and you place those products on the GB market, you are considered an importer of chemicals and must comply with the GB CLP Regulation.
Who Is Subject to GB CLP?
You have a legal duty to understand your obligations and duties under GB CLP if you’re:
- GB-based manufacturer, importer, downstream user or distributor who places chemicals on the GB market (known as a GB-based supplier)
- NI-based manufacturer, downstream user or distributor who directly supplies chemicals to the GB market (known as a NI-based supplier)
Compliance Obligations Under GB CLP
- Companies must adhere to mandatory classification, which is a classification that has been made legally binding within Great Britain. It is similar to the ‘harmonised classifications’ that exist under EU CLP. The mandatory classifications and the accompanying hazard labelling (MCL) are shown on the GB mandatory classification and labelling list (GB MCL list). You can access the list by clicking here.
- GB CLP substance notifications must be completed, and all information requirements must be met.
- Companies placing hazardous mixtures on the Great Britain market can voluntarily submit a notification to the NPIS (National Poisons Information Service).
- GB-based manufacturers and importers, as well as suppliers in Northern Ireland who place qualifying Northern Ireland goods (QNIGs) directly on the GB market, will have to notify HSE within one month of placing ‘new’ substances on the GB market unless one of the exemptions applies
