SEA Regulation No 28848 (Repeated) (Turkey CLP)
What Is the SEA Regulation?
The SEA Regulation is the Regulation on the Classification, Labelling and Packaging of Substances and Mixtures. It is a national adaptation of the EU CLP Regulation and aims to protect human health and the environment against the adverse effects of chemicals.
Scope of the SEA Regulation
In line with its purpose, the SEA Regulation establishes the obligations of manufacturers, importers, suppliers and downstream users concerning the classification, labelling and packaging of chemicals. It also covers the establishment of a national classification and labelling inventory, notification procedures and the creation of harmonised classification lists of substances.
In addition, substances that are subject to registration or notification under the KKDIK Regulation but have not yet been placed on the market are also subject to classification under this legal framework.
However, the Regulation does not apply to medicinal products, cosmetic products, medical devices, food and flavourings, or animal feeding stuffs supplied directly to end users as finished products.
Main Obligations Under the SEA Regulation
- Classification: Manufacturers, importers and downstream users must classify substances or mixtures according to their physical, health and environmental hazards before placing them on the market.
- Labelling: Packaging containing products classified as hazardous must bear a label in Turkish that includes hazard pictograms, signal words, hazard statements and precautionary statements.
- Packaging: Product packaging must be designed to prevent leakage, withstand handling and avoid attracting the curiosity of children or being confused with food.
- Classification and labelling notifications: Manufacturers and importers must notify the Ministry of the classification information for substances they place on the market through the Chemical Registration System (KKS) no later than one month after placing them on the market.
- Record keeping: Suppliers must retain all information used for classification and labelling for at least 10 years following the date on which they last supplied the substance or mixture.
- Supply-chain cooperation: All actors in the supply chain must cooperate to ensure full compliance with the requirements of the Regulation.
I Have Submitted an EU CLP Notification. Do I Also Need to Submit a SEA Notification?
Yes. A CLP notification submitted within the European Union does not remove the obligation to submit a SEA notification in Türkiye. Although the SEA Regulation was prepared in line with the EU CLP Regulation, it is a national Turkish legislation. The competent authority under the Regulation is the Ministry of Environment, Urbanisation and Climate Change. Therefore, notifications must be submitted directly to the Ministry through the Chemical Registration System (KKS), rather than through the EU system.
The only exception in Türkiye applies where the substance has already been registered in Türkiye under the KKDIK Regulation on the Registration, Evaluation, Authorisation and Restriction of Chemicals. Substances registered under KKDIK do not need to be notified separately to the SEA Inventory.
