    SDS Preparation for UA REACH

Under UA REACH, companies must provide a compliant Safety Data Sheet (SDS) for chemical substances and mixtures placed on the Ukrainian market. SDSs must be prepared in accordance with Ukrainian regulations and in the Ukrainian language to ensure safe handling and legal compliance.

Chemleg prepares UA REACH-compliant SDSs for your chemical products.

Who is required to prepare an SDS under UA REACH?

    • Manufacturers and importers placing hazardous substances or mixtures on the Ukrainian market
    • Formulators producing hazardous chemicals in their own production processes

What happens if an SDS is not properly prepared for Ukraine REACH?

    • Market access may be denied

If SDSs are found to be missing or incorrect during inspections, chemical products may be denied customs clearance or prohibited from being placed on the market.

    • Administrative fines and penalties may be imposed

In the event of non-compliance with Ukraine REACH obligations, administrative penalties may be issued by competent authorities such as the Ministry of Environmental Protection and Natural Resources of Ukraine (MEPR).

    • Products may be recalled

Improper SDSs can lead to product recalls, resulting in significant financial costs and reputational damage for companies.

    • Legal actions may be taken

Incorrect SDSs that lead to harm to human health or the environment may result in lawsuits, fines, or even imprisonment. Affected parties may also seek compensation.

      Frequently Asked Questions

What should I consider when preparing an SDS for Ukraine REACH?

Ensure that the SDS is prepared in Ukrainian and follows the GHS and CLP format. The SDS must reflect local use conditions and regulations specific to the Ukrainian market.

Companies located outside Ukraine that export chemical substances or mixtures above 1 tonne per year to Ukraine may prefer to appoint an Only Representative. Chemleg can act as your Only Representative, managing all official procedures including SDS preparation and registration on your behalf.

Only when the distributor makes any significant changes to the product (e.g. changes the mixture or introduces a new hazard), it needs to prepare a new SDS. Otherwise, it is responsible for forwarding the SDS received down the supply chain.

Suppliers shall update the safety data sheet without delay on the following occasions: as soon as new information on hazardous properties becomes available that may affect risk control measures; (b) once an authorisation has been granted or refused; (c) once a restriction has been imposed on production, use or placing on the market for a chemical substance.

SDS must also be updated when a registration number is assigned to the substance, or upon any change to the identification or contact details of the responsible legal entity.
